Welcome to Voucher Kini. These Terms of Service ("Terms") govern your access to and use of https://voucherkini.com/ and any related apps or services (together, the "Site" or "Services"), operated in Bangladesh by Voucher Kini ("Voucher Kini," "we," "us," "our"). By creating an account, browsing the Site, or purchasing a voucher, deal, or product through it, you agree to these Terms. If you do not agree, please do not use the Services.
These Terms should be read together with our Privacy Policy and Refund Policy, both available on the Site, which are incorporated into these Terms by reference.
1. Eligibility and Accounts
You must be at least 18 years old and capable of forming a binding contract under the laws of Bangladesh to use the Services or purchase a voucher.
To buy a deal, you generally need to create an account using a valid email address and/or mobile number. You are responsible for keeping your login credentials confidential and for all activity under your account.
You agree to provide accurate, current, and complete information when registering or making a purchase. We may suspend or close accounts that contain false information, or that we reasonably suspect are used for fraud, abuse, or violation of these Terms.
Creating multiple accounts to exploit promotions, referral bonuses, or deal purchase limits is not permitted and may result in suspension of all related accounts and forfeiture of associated wallet credit or vouchers.
2. What Voucher Kini Does — Our Role
Voucher Kini operates a marketplace that connects you with independent merchants, service providers, and, in some cases, sells physical goods directly. Our role differs depending on the type of deal:
Merchant vouchers/deals (services, restaurants, activities, and similar local deals): Voucher Kini is an intermediary. We sell you a voucher that entitles you to a good or service from the merchant named on the deal, on the terms stated in the deal's Fine Print. Voucher Kini does not provide, supply, or perform the underlying goods or services — the merchant does, and the merchant is solely responsible for the quality, safety, legality, and delivery of what it offers.
Physical goods sold by Voucher Kini: where a listing states the goods are sold and supplied directly by Voucher Kini, we are the seller of record for that order.
Third-party marketplace goods: where a listing states goods are sold by a third-party seller on our platform, that seller is the seller of record, and we act as an intermediary facilitating the transaction, payment, and (where applicable) delivery logistics.
3. Purchasing and Redeeming Vouchers
Deals are described on the Site along with deal-specific terms ("Fine Print"), such as expiry dates, blackout dates, redemption locations, and whether the deal is "Final Sale." The Fine Print forms part of your contract for that specific deal and takes precedence over these general Terms where the two conflict.
A purchase is confirmed once payment is successfully processed and you receive a confirmation (by email, SMS, or in-app notification) containing your voucher code.
Vouchers are generally single-use, non-transferable unless stated otherwise, and must be redeemed with the specific merchant and within the redemption window stated in the Fine Print, unless the voucher states that its value does not expire (in which case the merchant remains obligated to honor the paid value after the promotional redemption window, subject to the Fine Print).
You are responsible for reading the Fine Print before purchase, including any age restrictions, booking requirements, or exclusions (such as public holidays or specific dates).
Cancellations, exchanges, and refunds are governed by our Refund Policy.
4. Pricing and Payment
Prices displayed on the Site are in Bangladeshi Taka (BDT) and, unless stated otherwise, are inclusive of applicable VAT/taxes.
We accept payment through supported mobile financial services (such as bKash, Nagad, and Rocket), debit/credit cards, and other payment methods shown at checkout. Payments are processed by licensed third-party payment gateways/MFS operators, and your use of those services is also subject to their own terms.
We reserve the right to correct pricing errors on the Site, and to cancel and refund orders placed at a clearly erroneous price before the order is fulfilled.
Promotional codes, referral credits, and Voucher Kini Wallet balances are subject to any additional conditions stated at the time they are issued, and have no cash value except as expressly stated.
5. Your Conduct
When using the Services, you agree not to:
violate any applicable law, including consumer protection, e-commerce, or tax laws of Bangladesh;
impersonate any person or entity, or misrepresent your affiliation with one;
post or transmit content that is defamatory, obscene, harassing, hateful, or otherwise objectionable;
use the Site to spam, phish, or distribute malware, or to scrape, reverse-engineer, or interfere with the Site's operation or security;
resell vouchers for commercial gain unless expressly authorized in writing by Voucher Kini; or
attempt to manipulate reviews, ratings, referral programs, or promotional offers.
We may remove content, suspend accounts, or refuse service to anyone who violates these Terms, at our reasonable discretion.
6. User Content
If you submit reviews, ratings, photos, comments, or other content to the Site, you grant Voucher Kini a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, and distribute that content in connection with operating and promoting the Services. You represent that you have the rights to submit that content and that it does not infringe any third party's rights. We may remove user content that violates these Terms or applicable law at our discretion.
7. Intellectual Property
The Site, including its design, text, graphics, logos, and the "Voucher Kini" name and marks, is owned by or licensed to Voucher Kini and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use. You may not copy, modify, distribute, or create derivative works from the Site or its content without our prior written consent.
8. Merchant Relationship and Disclaimer
For merchant-fulfilled vouchers, the contract for the underlying goods or service is between you and the merchant, once the voucher is redeemed or a booking is confirmed. Voucher Kini is not a party to that contract and does not guarantee the quality, availability, legality, or safety of any merchant offering.
We make reasonable efforts to vet merchants listed on the Site, but we do not independently verify every claim a merchant makes about its offering, and we are not responsible for a merchant's failure to honor a valid voucher, subject to our Voucher Kini Promise described in the Refund Policy.
If a merchant closes, becomes insolvent, or otherwise cannot honor a voucher, contact us — we will work with you on a resolution (such as a refund or an alternative deal) as described in the Refund Policy, though we cannot guarantee a specific outcome in every case.
9. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Voucher Kini disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Nothing in these Terms limits any statutory rights you have under Bangladeshi consumer protection law that cannot be excluded.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Voucher Kini and its officers, employees, and agents will not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, or data, arising out of or related to your use of the Services. Where liability cannot be excluded, our total liability to you for any claim arising from a specific transaction is limited to the amount you paid for the relevant voucher or product, except in cases of fraud, gross negligence, or death or personal injury caused by our negligence, or where such limitation is not permitted by law.
11. Indemnification
You agree to indemnify and hold Voucher Kini harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
12. Suspension and Termination
We may suspend or terminate your account or access to the Services, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraud or abuse, or if required by law. You may close your account at any time by contacting us; any unredeemed vouchers or wallet credit will be handled according to our Refund Policy and applicable law.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services or in Bangladeshi law. We will post the updated Terms on this page with a revised "Last updated" date, and where changes are material, we will provide reasonable notice (such as an email or Site banner) before they take effect. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the People's Republic of Bangladesh. Any dispute arising out of or relating to these Terms or the Services will first be addressed through good-faith negotiation with our customer support team; if unresolved, it will be subject to the exclusive jurisdiction of the courts of Bangladesh, without prejudice to any right you may have to bring a claim before the Directorate of National Consumer Rights Protection (DNCRP) or another competent consumer authority.
